      “Ramadhan Kareem’ itulah salah satu ungkapan kata yang sering terdengar dalam bulan ramadhan, yaitu berupa ucapan langsung ketika bertemu teman sesama muslim, dan“wallahu Akrom” sebagai jawaban atas ungkapan di atas. Tradisi mengungkapkan dan menjawab seperti itu awalnya biasa dilakukan oleh orang-orang (mahasiswa) timur tengah yang kuliah di Malaysia, tetapi ungkapan itu sekarang seakan sudah menjadi milik bersama yang sering kita dengar dari seluruh mahasiswa muslim yang belajar di IIUM.

            IIUM (International Islamic University Malaysia) atau biasa disebut UIA (Universiti Islam Antarabangsa) adalah sebuah universitas internasional terkemuka yang mempunyai mahasiswa asing terbanyak di Malaysia. Menurut catatan, mahasiswa yang belajar disana berasal lebih dari 100 negara, dan jumlah mahasiswa Indonesia diperkirakan mencapai lebih dari 250 pelajar, mulai dari jenjang  S1, S2 dan S3.. القضاء على الغائب في الاختلاس – دراسة مقارنة

تهدف هذه الدراسة إلى إظهار مفهوم القضاء على الغائب في الفقه الإسلامي والقانون الجنائي بإندونيسيا وإلقاء الضوء على مدى مشروعية القضاء على الغائب في الاختلاس وكيفية إجراءاته ثم المقارنة ببيان أوجه التشابه والاختلاف بينهما. واعتمد الباحث في دراسته على المنهج الاستقرائي لتتبع النصوص الواردة في القرآن الكريم والسنة وآراء الفقهاء في القضاء على الغائب والأمور المتعلقة بها، كما اعتمد الباحث على المنهج التحليلي لمراجعة الموضوع في الدراسات الفقهية السابقة وتحليل المواد القانونية الجنائية بجمع ما ورد حول هذا الموضوع في مؤلفات الفقهاء القديمة والحديثة، ويعتمد أيضاً على المنهج المقارن وذلك بالمقارنة بين أقوال الفقهاء وبيان الراجح منها، ثم المقارنة بين القول الراجح في الفقه الإسلامي والقانون الجنائي. ولقد توصلت الدراسة إلى إن الفقه الإسلامي والقانون الجنائي كلاهما يحظران بصرامة الاختلاس؛ لأنه من جرائم الأموال التي تسمى في القانون الجنائي بـ “الجرائم غير العادية” (extra ordinary crimes)  وكلاهما أجاز القضاء على الغائب خاصة في الاختلاس، وترجح القول بجواز القضاء على الغائب بما له علاقة بحقوق الناس فقط وهو قول الجمهور، وعلى وجه عام تكون شروط إجراءات القضاء على الغائب في المحكمة وطرق إثبات الدعوى على الغائب في الفقه الإسلامي لا تختلف كثيراً عن القانون الجنائي كما كانت في القضاء على الحاضر، وأتاح كلاهما الحقوق والفرصة الكافية للدفاع عن حقوق المدعى عليه لأجل الإصلاح وتحقيق العدالة إذا حضر المدعي عليه الغائب قبل صدور الحكم أم بعده. والكلام عن إجراءات القضاء على الغائب في الفقه الإسلامي طويل ومفصل حيث اختلف الفقهاء في ذلك في حين أن الكلام في القانون الجنائي لم يكن مستفيضاً موسعاً وإنما جاء بشكل موجز لم يتضمن كل الإجراءات اللازمة ويحتاج إلى إعادة النظر لتوضيح بعض المواد والاستعانة بالفقه الإسلامي.

This study tries to elaborate the understanding of trial in absentia according to Islamic criminal law and Indonesian criminal law, as well as the procedure in which a trial is conducted by making comparison between the two. For the study, three approaches have been adopted. The first is the inductive method which traces the texts which are written in the Holy Quran and Sunnah as well as the views of scholars on trial in absentia and matters related thereto, the second is the analytical approach which reviews the topic in the books of  past scholars and analyses on criminal matters related by collecting the data on this subject in the works of traditional and modern scholars, and the last approach is the comparative method which compares the opinions of scholars in Islamic and Indonesian criminal law, choosing which statement is to prevail. It is concluded that Islamic and Indonesian criminal laws have strictly prohibited the act of corruption as it is a crime that relates to money and is considered in criminal law as extra ordinary crime. Both laws allow trial in absentia in this matter. The trial in absentia is not much different than the trial in the presence of the parties concerned, provided adequate opportunity to defend the rights is given to achieve justice if the defendant appears in the court before or after the judge gives the sentence. The subject of trial in absentia in Islamic criminal law is long and complex as the scholars have many views and arguments. The discussion in criminal law is extensive, but in summary it does not include all the necessary measures, therefore it needs to be reviewed and clarified with the help of Islamic jurisprudence.

Recognizing Errors in Thinking

I. Introduction

Humans have a great capacity to be wrong our natural biases, habits of thought intuitions, and heuristics usually serve us well. However under certain circumstances they can also lead us directly towards error. Intelligent people are more than capable of holding irrational ideas that recruit subjective belief more than objective facts and evidence. Having qualifications and intelligence are no guarantee that ones views are correct. This writing tries to discuss kinds of errors that occur to human being. This document outlines just some of the main fallacies, errors, and mistakes of reason commonly directed towards human.

Really high quality people endeavor (try hard) to make as few mistakes as possible. He has Life-Goal of not making mistakes, as we know that the fewer mistakes we make the less trouble we will have, and the smoother and more successful will be our life. There are several kinds of mistakes. One kind is simply an accident. A completely unexpected event occurs. Another is caused by not having all the correct information necessary to prevent the mistake.

II. Three kinds of errors consist of:

1.      “ Mine is better” thinking selective perception

2.      Bias.

3.      Pretending to know
